1. Acceptance of Terms

By accessing or using RIVAL ("rival.tips", the "Website", or the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

RIVAL is an AI model comparison platform. The Service includes:

• Viewing and comparing pre-generated AI model outputs across identical prompts
• Voting in blind duels and model comparisons
• Creating custom AI challenges (Pro users)
• Purchasing the RIVAL Datasets product
• The model sponsorship program
• Developer tools including .llmignore builder, AI badges, nutrition labels, and MCP server

3. Accounts

You may browse the Website without an account. To access certain features (such as creating challenges), you must create an account using your email address or a third-party authentication provider (Google, GitHub). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Subscriptions & Payments

RIVAL offers free and paid subscription tiers. Paid subscriptions (Pro, Pro Plus) provide additional credits for creating AI challenges. Payments are processed by Lemon Squeezy. By subscribing, you agree to the recurring billing terms presented at checkout.

• Credits are consumed when AI challenges are successfully processed.
• Failed challenge processing results in automatic credit refunds.
• You may cancel your subscription at any time. Access continues through the end of your current billing period.
• Top-up credit packs are non-expiring and non-refundable once purchased.

5. RIVAL Datasets

The RIVAL Datasets product is a one-time purchase containing pre-generated AI model responses and associated metadata.

Free Sample

• Licensed for research and personal use only.
• Contains metadata only (no response content).

Full Dataset (Paid)

• Grants a non-exclusive, non-transferable, perpetual license for commercial use.
• You may use the dataset in commercial products, for model training, and in published research.
• Attribution is required: include "Data from rival.tips" in your work or documentation.
• You may not resell, redistribute, or publicly host the raw dataset. Derivative works and analysis are permitted.
• Single-seat license covering one person or team, unlimited projects.

Warranties & Disclaimers

The dataset contains AI-generated content produced by third-party models. RIVAL does not warrant the accuracy, completeness, or fitness for any particular purpose of the AI-generated content within the dataset. The dataset is provided "as is". You are responsible for evaluating the suitability of the data for your intended use.

6. Model Sponsorship Program

The model sponsorship program allows AI model providers or third parties to purchase featured placement for a specific model on the RIVAL platform.

• Sponsorships are billed monthly via Lemon Squeezy with no long-term commitment.
• You may cancel at any time. Featured placement remains active until the end of the current billing period.
• Sponsored models are clearly labeled with a "Featured" badge across the platform.
• Sponsorship does not influence blind duel outcomes, community vote tallies, or editorial rankings.
• RIVAL reserves the right to decline or terminate a sponsorship at its discretion.

7. User-Generated Content

When you create challenges as a Pro user, you retain ownership of the prompts you submit. You grant RIVAL a non-exclusive, worldwide, royalty-free license to store, display, and process your prompts for the purpose of generating and displaying AI responses on the platform.

AI-generated responses are produced by third-party models via OpenRouter and are subject to the terms of the respective model providers. RIVAL does not claim ownership of AI-generated responses but reserves the right to display them on the platform and include them in aggregated, anonymized datasets.

8. Affiliate Links & Sponsored Content

The Website contains affiliate links to third-party products and services (including but not limited to ElevenLabs, Cursor, OpenRouter, and other developer tools). If you make a purchase through these links, RIVAL may receive a referral commission at no additional cost to you.

Affiliate relationships do not influence model comparison results, rankings, or editorial content. Affiliate links are marked with appropriate HTML attributes (rel="sponsored").

9. Intellectual Property

The RIVAL platform, including its design, code, branding, and pre-generated content curation, is the property of RIVAL. AI model responses displayed on the platform are generated by their respective model providers. Model names, logos, and trademarks belong to their respective owners and are used on RIVAL for identification purposes only.

10. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to scrape, crawl, or systematically download content from the Website beyond what is provided via official APIs or datasets.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Manipulate voting or duel outcomes through automated means or coordinated inauthentic behavior.
• Use the Service to generate, store, or distribute illegal, harmful, or abusive content.

11. Limitation of Liability

To the maximum extent permitted by applicable law, RIVAL and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Indemnification

You agree to indemnify and hold harmless RIVAL and its operators from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. The updated version will be indicated by an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to provide notice via the Website or email.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RIVAL operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the courts of competent jurisdiction.
